The Mexican Senate passed a law Feb. 26 that prohibits smoking in any closed public space, including bars, restaurants, public transportation, schools and workplaces.

Violating the norm will carry a fine equivalent to US$500, and the sale of cigarettes to minors a fine of $2,000 — a figure that jumps to $50,000 if they are sold in schools attended by minors.

Business owners caught breaking this law could have their business closed, either temporarily or permanently.

The law also requires cigarettes to carry a label that warns consumers against the health risks they cause including cancer and other diseases, and limits cigarettes advertisements.

Tobacco giants Philip Morris and British American Tobacco say the law attacks local industry that pays taxes, although they admitted that cigarettes do cause health damage.

An estimated 14 million Mexicans — of a population of 104 million — smoke, and the government says an average of 165 Mexicans die every day from tobacco-related illnesses.

Smokers argue that the law violates their constitutional right to free choice and that some bars and restaurants should be designated for smokers only.

“No one is arguing that tobacco is good for your health or does not cause second-hand damage. What we're saying is that there should be places, above all bars, with special permission to accept smokers and all of those who decide to enter at their own risk,” said sociologist Isabel Klein.
